Jail for water scooter rider

GEORGE TOWN: A Myanmar national was jailed six months by a magistrate’s court for ramming his water scooter into a tourist.

Magistrate Noor Aini Yusof also fined furniture factory worker Nay Lin RM1,000 for grievously hurting Zhu Li, 47, at the beach near the Golden Sands Resort in Batu Ferringhi at 9am on Feb 5.

Zhu Li was walking on the beach with five of her family members when she was hit by the machine from behind, leaving her with broken legs.

Nay Lin, 32, who was unrepresented and spoke through an interpreter, had on Feb 16 pleaded guilty to committing a rash or negligent act that could endanger a human life under Section 338 of the Penal Code which carries a maximum jail term of two years or fine up to RM2,000 or both upon conviction.

In passing sentence, Noor Aini said Nay Lin had committed a serious crime that threatened Zhu Li’s life.

“The victim’s injuries were very serious and the incident could have cost her life,” she said.

She added that she had taken into account public safety and the fact that the incident was the migrant worker’s first conviction.

In mitigation, Nay Lin apologised to the victim and stressed that it was an accident.

“I am very sorry, I never meant to hit her. I can ride a motorcycle and thought that riding a water scooter would be the same, but I was wrong,” he said.

Nay Lin, who works in Kuala Lumpur, said he needed to continue working as he has to support his family back in Myanmar.

Nay Lin’s employers, who were present in court yesterday, paid the RM1,000 fine.

It was reported that on the day of the incident, Nay Lin together with another Myanmar national, who was riding pillion, were detained by water sport beach boys after the collision and handed over to the police.

Zhu Li, who was discharged from the Penang Hospital on Feb 23, has been advised to stay in the country for six months to allow her wounds to heal before heading back to China.

The water scooter incident, which made headlines, prompted the Penang government to announce a temporary ban on all water sports on the Batu Ferringhi beach front and the drawing-up of new guidelines for the popular tourist spot.
